Orange County DUI Attorney

Welcome to the website for the top DMV and DUI Lawyer in Orange County. The firm has been specializing in DUI Defense in Orange County & all Southern California counties for more than 15 years.  If you, a relative or someone you know and care about has been arrested for driving under the influence (DUI) in Orange County, or the surrounding counties (Los Angeles County, San Diego County, or Riverside County), or has received a letter from the California Department of Motor Vehicles Driver Safety Office threatening a driver's license suspension or driving privilege suspension, please read the material presented in the "What to Do First" and "DUI Overview" sections of this website, then seriously consider hiring our experienced and locally based DUI Lawyer who focuses exclusively in DUI defense and California driver's license suspension matters.

California DUI Laws are complicated. A Orange County DUI arrest most often initiates two separate driving under the influence cases. The first DUI case is the criminal case, while the second DUI case is the DMV case. Those arrested for drunk driving who hold professional licenses (attorneys, physicians, nurses (registered nurses or licensed vocational nurses), physical therapists, teachers, certified public accountants (CPA's), pilots, stock brokers, bankers, veterinarians, x-ray technicians, or other professionals) are at risk of having an additional case initiated by the board or commission which issued the license which may impact their ability to practice their profession. Individuals who hold positions of trust, such as police officers, fire fighters and commercial truck drivers will also be presented with specific issues requiring special consideration.

Orange County District Attorney’s Office also fiercely pursue marijuana DUI cases.  Orange County prosecutors can prove marijuana was present in someone's system pretty easily because traces can remain in your system for 13 to 90 days.  For this reason proving the marijuana impaired someone's ability to drive is much more difficult and an knowledge Orange County DUI Attorney can help you fight the DUI charges.

As with alcohol, California Vehicle Code section 23152(a) outlaws driving under the influence of drugs or medication, imposing penalties that are mostly similar alcoholic DUI.  California DUI of marijuana is unique, however. For example, our Orange County DUI Lawyer points out that many studies show that the initial effects of ingesting marijuana include heightened focus and awareness. Because the Orange County prosecutor can only earn a conviction for DUI of marijuana by proving impairment, this means science may actually be on the DUI defendant's side in these situations.

Orange County DUI arrests involving a combination of marijuana and other substances can be more complicated. Orange County prosecutors may argue that a combination of marijuana and alcohol caused legal impairment in a driver even though his or her blood alcohol content was below the legal limit of .08%. However, these situations don't provide prosecutors with open-and-shut cases. Multiple avenues of challenge and advantage may be available to the client.

Being arrested for DUI of marijuana sends many people into an understandable state of shock and fear because they assume that simply possessing a controlled substance dooms their chances at a successful defense. While the reaction is understandable, the assumption is absolutely wrong. People should never fail to consult with our Orange County DUI Lawyer in order to obtain a professional opinion about the possibilities and potential of defending a marijuana-related charge.

Following an Orange County DUI arrest, out of state drivers are presented with additional legal issues as a because the state which issued them a driver's license (home state) can be expected to initiate an additional case against their driver's license which may carry additional consequences in addition to those which may result from the California Department of Motor Vehicles DUI suspension case.

If a person is not a citizen of the United States, the risk exists of deportation, denial of naturalization, exclusion from admission to the United States, exclusion from readmission to the United States following travel outside of this country, denial of an extension of an H1B work visa or an upgrade to Lawful Permanent Resident (also called, Resident Alien Permit Holder or Green Card Holder) or other upgrade of status with the United States.

From the moment a person is stopped by a California Highway Patrol Officer, local Orange County Sheriff, or other law enforcement officer, they are being subjected to a standard Orange County DUI investigation and incriminating evidence is being collected. A driver's physical appearance and performance on so-called field sobriety tests will be recorded on a police report, as well as the result of a Preliminary Alcohol Screening device, evidential breath test, or evidential blood test.

While serious, the consequences of a first time DUI arrest in Orange County are less severe than those of a second offense DUI arrest, as prior DUI convictions bring the wrath of judges and prosecuting attorneys. Multiple DUI cases such as a third arrest for driving under the influence or even a fourth arrest for drunk driving will lead to increasingly serious DUI penalties, including he case being filed as a felony DUI.  As a result, penalties may also include mandatory jail time or even a state prison commitment. Penalties are also increased further if you are arrested for underage DUI in Orange County.  A college student with a DUI arrest can also derail a young persons career goals.

Additionally, the consequences of a Orange County DUI accident or a DUI accident causing injury or death are very severe and may lead to an actual jail or prison sentence. Although there are DUI defenses which may apply to particular cases (see Women DUI for defenses available to women), many inexperienced DUI Lawyers overstate the extent to which these defenses may be available to a particular individual's DUI case.
